Ask a Law Question, Get an Answer ASAP!
Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
You said you have contacted the Solicitors - what is it I can help you with today please?
Thanks for taking the time to speak with me
I'll explain as briefly as I can
Thanks for posting the question
After a road traffic collision dating back to April 2010 I won a court case against a third party.
My solicitor over paid me & provided me with a settlement figure greater than I was intended, this was not to my knowledge
How much was the overpayment please?
Ok - got that letter yes
They said I was owed approx £1400 for injury plus £300
When you have written to the Solicitors what have they said?
£1300 was supposed to go to elephant insurance
& £680 to hire car company
but they were sent a one lump sum cheque from third party insurer then they forwarded this amount onto myself
hold I will send file
Were you at Court when the Judge gave the award please?
Ok - so did you not realise you were overpaid?
Have you spent the overpayment please?
but the figures I do not recall
I spent the over payment, on putting towards a new car... then a few months went by & elephant contacted me
I had to take out a credit card to pay them the £1300 approx back as I was scared that I had spent someone else's money
The next step is to complain to:
but in hind sight acsl solicitors cause this problem
I have complained to them
They are independent and can examine your complaint for free
Their website is: http://www.legalombudsman.org.uk/
Then the next step after that is to complain to the regulator
They are the Solicitors Regulation Authority
They can also investigate
Their website is; www.sra.org.uk
They can see if there have been any breaches of the Solicitor rules
Sadly I think you do have to pay it, as you had money you were not entitled to
But I think the SRA may suggest the Solicitors may more than the £150 offered
But do that and hopefully it should resolve the matter
also the hire car company is still unpaid & are chasing their money, which I have told them to wait until I have consulted with ACSL
Can I clarify anything for you about this today please?
Can I clarify anything else for you?
Will the hire car company wait if I tell them I have made a complaint to the legal ombudsmen
I can't say - if you have it confirmed in writing receipt about your complaint with the Ombudsman and SRA they amy
* may *
My issue is with the solicitors
Which is why you should go to the Ombudsman and then the SRA
but if I pay the hire car company I will be omitting liability... right?!
No, you could pay it without admission of liability
Does this answer your question today or can I help further?
Thanks you for your time...
