Can I sue Mercedes.
Was the car purchased from them directly?
No my son in law was first owner. I bought 3 years ago
but did he buy it direct from them?
He bought from Mercedes dealer in Maidenhead. I am in touch with Head Office.

Personally you will have no claim against Mercedes. You bought the car from your son and any contract in law that is in place would be with him – there was never a contractual relationship between you and Mercedes and as such you cannot pursue them. Also a manufacturer is not liable for any faults that occur after purchase – only the seller is and that can only happen if it can be shown that the item was faulty at the time of purchase or if was not of satisfactory quality. In these cases only the original buyer can make such a claim, in this case it would be your son. Another issue however is that there is a time limit for making these claims and they are 6 years from date of purchase. If the car was bought 7 years ago, even he would be out of time to make a claim for this. The only way you can pursue this is to sue your son as he is the one that sold you the faulty car, although I appreciate it is something which you would not want to do in the circumstances.
