Hello my name is Alex and I will help you with this. Please note that I am a working Solicitor
and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply, but rest assured I will be giving your question my immediate attention upon return You do not need to wait here as you will get an email when I reply.
How is it I can help you with this today please?
Well I took your advice to write to them they never wrote back or even acknowledged that they received the letter, and you sort of said that would prevent this. Now what do I do I do not want to go to court but this is not their money they closed my account with them.
Remind me what is the value?
NO Alex I have only got a letter today? Do I need a lawyer and is this going to cost me a lot of money and do I have any chance against such a large company.
Hi Alex have you had a chance to review what I have said so far?
I am not around this afternoon as I have a hospital appointment.
If its below £10,000 then you don't need a lawyer as you can do this yourself.
You must file a defence setting out your position
But in short if they did not do any work they are not entitled to payment'
Why should you pay a firm to do something when they have not done anything?
But you must file a defence
If its below £10,000 it will be a small claim, you wont need a lawyer and its a very informal hearing
Can I clarify anything for you about this today please?
Would I stand a chance against such a huge company Alex. and can the money I owe go up if I decided to go all the way to court. do the little people ever win?
HOw do you file a defence???
Yes you have a good chance.
A defence is just a response to the claim form.
A claim form is in numbered paragraphs, you either admit or deny each paragraph.
Does that clarify matters for you?
