Himy neighbour is selling his house through a private sale.This

Resolved Question:

Hi
my neighbour is selling his house through a private sale.
This neighbour has built a large garden right across my rights of way and moved my access over a 3rd party's land.
He does know about this but is adamant he has done nothing wrong.
What I would like to know is would the new buyers solicitors
find all this out when it starts to go through.
Or could it all possibly go through?

It may or may not be picked up, depending on the competence of the solicitors or registered conveyancers involved.

Your neighbour is obliged to disclose this issue with you to the potential purchaser.

If this neighbour manages to sneak his sale through and the buyers solicitor does not spot the issue what would happen?

That would be an issue for the new buyer, he could claim damages for breach of contract against the seller and claim negligence against the solicitor who failed to spot the issue.

You may make a claim against the new buyer for your right of way to be reinstated.
