I have very serious concerns regarding a council planning approval

Resolved Question:

I have very serious concerns regarding a council planning approval process for a large development. Every avenue pursued to be able to speak out and ask questions has been thwarted, despite the public meetings being set up for just this process. Can you advise which ombudsman would deal with this issue and what is the proper manner with which to raise my request in an in dependant review of a process which gives every appearance of being improper.

Alex Watts :

Hello my name is ***** ***** I can help you with this.

Alex Watts :

There are several options available, some free, some involve Court

Alex Watts :

You should first complain to the Chief Officer regarding the conduct of the Council

Alex Watts :

That office will investigate the matter and report back to you

Alex Watts :

This department handles all the complaints so not involved in the actual decision

Alex Watts :

If you are unhappy with the response then the next step is the Ombudsman

Alex Watts :

They are independent of the Council and will review what has been done and say whether it is correct and proper

Alex Watts :

They offer a free service at: www.lgo.org.uk

Alex Watts :

Finally you can consider a Judicial Review. This is where a Judge of the High Court considers the actions taken by the Council (including stopping people speak) and decides whether their actions are legal and reasonable

Alex Watts :

A Judge can agree with the decision or remit it back for further consideration

Alex Watts :

Clearly High Court matters you would need a Solicitor and therefore need to pay for representation

Alex Watts :

But if you win the Judicial Review then you should get costs awarded

Alex Watts :

Can I clarify anything for you about this today please?
