Hi We contracted a small website company to build a website

Hi
We contracted a small website company to build a website for our company which would be open source and built in 4 months the website has taken over a year to produce and not been built to scope agreed. It has cost us £10k pound can we take legal action to reclaim funds given the product delivered is not what we asked for. We have contracted a seperate company to help move the website off there platform they want to delete our files off there servers. As we are considered legal action will that be required and we stop them from doing do till we resolve this dispute

Its quite significant the website solution delivered relies heavily on the companies custom made solutions if you remove these products from the build the website we walk away with is not functional so not fit for purpose. Hence tour request for use of open source solution was not meet. They claimed the solution provided was not a lock in to them and built using off the shelf products to ensure if we did leave we would take a functional website away onto another hosting provider. This will not be the case. Hence under these grounds we believe they have breached there contract and the website is of no use to us if we don't stay on their platform

Im not clear whether you are saying that the original site was useless to you or the solution unfairly locked you in? Or both?

The website delivered has issues and is not a issue free solution we have had a number or problems processing orders so it was not signed off from us as a complete finished website and yes it also locks us in, so both
