Customer Question

after visiting a local eatery my wife, who is a disabled driver, had a puncture when leaving the eatery still on the private estate, she stopped and rung for assistance which arrived within 10mns after the wheel was changed she continued home only to receive a parking charge notice some days later from a company called vehicle control services, demanding payment of £60 i appealed to them with the mitigating circumstances but the appeal was turned down, the fine is now £100 do i have to pay or can i fight this any other way, cars dont have a choice where they break down and my wife certainly wasnt capable of changing the wheel herself

Alex Watts :

Hello my name is Alex and I will help you with this.

Alex Watts :

No you do not have to pay

Alex Watts :

If you did not call them then there is no contract between you and the Company

Alex Watts :

If the matter went to Court they would have to prove there was a contract, you agreed to their terms and you suffered a loss

Alex Watts :

Given that you broke down, I assume the terms were not clearly visible.

Alex Watts :

In any event I can not see how they suffered a loss for those 10 minuites

Alex Watts :

As such no, you do not have to pay.

Alex Watts :

You have no contract, you did not agree to their terms and they did not suffer any loss

Alex Watts :

Can I clarify anything for you about this today please?
