Hello my name is ***** ***** I will help you with this.
What do their terms say about cancellation and situations where there have been sold previously please?
Hi I have sent you through the seller terms...................plus some FAQ answers:-
Can I remove my tickets if I sell them elsewhere? As long as the tickets haven't already sold, you can remove your listing at any time.
-Log into your GET ME IN! Account and click on My Listing-Choose Show Details next to the listing you want to edit or remove-Scroll down to find the Listings Live and and make sure it's un-ticked-Hit Update and your tickets will now be offline
If you do not receive a confirmation of de-listing email after this then please contact us immediately using the Contact Ustab above as the tickets may still be live on the website.
If you've already had a sale, unfortunately you can't remove them from the website.
Can I cancel this sale? Unfortunately we can’t cancel any sale after the tickets have been purchased, because once a sale is made against a listing, you have entered into a contract to supply those tickets. Just as we protect you by not allowing the buyer to cancel, in turn we have to protect the buyer by making sure they get what they pay for.
I can no longer supply the tickets I have sold and the event is more than 7 days away?
If you can’t supply tickets that you have sold and the event is more than 7 days away, please let our seller support team at *****@******.*** and we'll be happy to help. Please be sure to include your name and the specific order reference number that you can't supply.
How long after they had been sold were the second set sold?
Sorry, I had one pair of tickets that I listed on both sites, unfortunately they were sold on Viagogo on Saturday 23rd August, but before I could take my tickets of "getmein! (AKA Ticketmaster), they also sold the tickets.................tried to cancel both sales but neither organisation would let me - both threatened me with the charges as outlined in their terms.
What I have since done is sold the tickets via Viagogo, but now have to source alternative tickets to fulfil the Getmein order.............this will inevitably cost me!! What would you advise??
Yes but when did Getmein sell the tickets?
Hi, I sold through Viagogo on 22nd August, and via GetMeIn on 24th August.
Its bad news I am afraid.
Clause 2.3 says you must be reachable.
Therefore if you had sold the tickets with the one site then you could have removed the listing from the second.
You did not and in effect you gave authority to sell a second pair of tickets which you did not have.
This created a contract between the site and the buyer of those tickets.
Sadly you have to fulfill that order otherwise it would be breach of contract.
This means that the site or the buyer of the tickets could sue you for breach.
I am sorry but sadly you should have either only listed on one site at a time or in the alternative made yourself available to remove them when they had sold
I have examined the terms and these are your responsibilities.
I am sorry if this is not the answer you are looking for and certainly not the one I want to give you, but I have a duty to be honest
Can I clarify anything for you about this today please?
No, it is as I expected...............
