We are in the process of building an extension to the house.

Resolved Question:

We are in the process of building an extension to the house. We agreed a contract with the builder for a package including supply and fit of a kitchen. Unfortunately the builder has disappeared after it became apparent they were in heavy debt. We unfortunately have paid the full contract price.
The kitchen was arranged through a local manufacture who will only deal with trade so whilst we chose the design the contract and purchase was made via the Builder. The kitchen and flooring has been delivered and is currently stored pending a further builder to finish the construction and fit the kitchen. My concern is that whilst we have paid the builder and he has supplied the kitchen the original supplier may not have been paid and may be able to have a call on us to return the kitchen . Can you advise please

Alex Watts : Hello my name is ***** ***** I will help you with this.
Alex Watts : The supplier would have no claim on you.
Alex Watts : His claim is against the builder.
Alex Watts : The supplier has no contract with you.
Alex Watts : This means any claim can only be against the builder and not you.
Alex Watts : You have nothing to worry about.
Alex Watts : Can I clarify anything for you about this today please?
Customer:

I thank you for that we are very nervous after the week we have had. Added to this a plumber entered our property and removed the boiler which had been fitted which I'm dealing as a criminal matter but we became concerned that the kitchen supplier may have a call

Alex Watts : Yes indeed. As you say it's a criminal matter.
Alex Watts : But don't worry about the kitchen supplier.
Alex Watts : Does that help ?
Customer:

As long as we can be rest assured about the Kitchen supplier not serving a court order or similar then I can sleep a bit better

Alex Watts : Yes indeed.
Alex Watts : Does this answer the question for you today?
