Hello We had a solar panel installed (the type to heat the water) in February 2009 by Solar Home Energy (who went out of business very shortly afterwards without giving us a guarantee). We had taken a loan out with Barclays Finance to part fund this as we were lead to believe that Solar Home Energy were affiliated to Barclays. the system went wrong within six months and Barclays eventually (after countless letters) refunded us the sum that we had paid to have it fixed. It went wrong again a year or so later and Barclays wanted us to find someone to fix it (in fact they asked for two quotes). We could not do this and after about a year it went into the hands of the Financial Ombudesman who then forced Barclays to find someone to repair it. After another long wait they eventually found a firm, but not before the stress of it all caused my husband to have a severe stroke (I am now his carer). It was fixed last year but it has gone wrong again and I have written to Barclays Finance and they have said they would get someone out to fix it - this was a month ago and although I have written to them asking for them to attend to this they have not replied. I have said all along that I do not feel this system is fit for purpose, it was mis-sold, lies were told as they were desperate to get the business (Solar Home Energy that is) to save themselves going out of business. I have all the documentation and I would like a full refund (we have paid out about £10,000 including the interest). It is causing us both stress again as it is making some very terrible noises in the loft. Can you help - could I take it to the Small Claims Court. Regards ***** *****
We have paid out about £10,000 and this is what I want refund as per Section 75 of the Consumer Credit Act 1974. The system is not fit for purpose.
Barclays are liable under Section 75 of the Consumer Credit Act 1974 and although the Financial Ombudesman stated that Barclays Finance would take on the responsibility of the Guarantee whilst we were still in the property. Also already the £36.00 has been taken from my card - I thought the first seven days were free!!!!
