The Ombudsman has ruled that a local NHS , Primary Care Trust

Resolved Question:

The Ombudsman has ruled that a local NHS , Primary Care Trust was liable for Continuing Care, but this was met by the patient during his lifetime. The Trust through the CCG appears to be refusing to pay out the patients estate. What authority has the Ombudsman got to enforce payment.

Alex Watts :

Hello my name is ***** ***** I will help you with this.

Alex Watts :

The Ombudsman has NO POWER to enforce any recommendation for payment.

Alex Watts :

All the Ombudsman can do is recommend.

Alex Watts :

That means all you can do is issue proceedings on the back of the Ombudsmans findings

Alex Watts :

You are seeking an Order that the CGT are compelled to carry out what the Ombudsman suggest

Alex Watts :

But you need to issue proceedings

Alex Watts :

I realise this may not be the answer you want and certainly not the one I want to give you, but I have a duty to be honest
