How much did you pay for it?

Ok - have you taken it somewhere else to get an independent view?
Does the fault mean you can't drive it?

Have you taken it to any independent garages of VW, for example Halfords?
I would get it looked at by another expert and they can tell you what is wrong with it.
Or I would consider using a Court approved expert mechanic to look at it.
That expert can produce a report saying what is wrong.
Save the cost of that report.
Then when you go back to VW you can show them the report and ask for the cost back
If they do not carry out the repairs suggested you can get them done elsewhere and seek a refund of the cost including expert report.
Or if they do not pay the expert report you can still pursue a claim
You need to write and set out your losses and request a refund within 14 days or say you will go to Court within 14 days. You should make sure you send this signed delivery and keep a copy.
If they do not refund you then you can issue proceedings in the County Court. You can either do this online at: www.moneyclaim.gov.uk or by completing form N1 http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n001-eng.pdf and take it to your local County Court.
The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.
If the matter is defended it will be set down for a trial. If the claim is for £10,000 or less it will be a small claim and you will not need representation.

If so, then no
You lose that right under the Sale of Goods Act if they attempt a repair
And even then it has to be declared unroadworthy for them to refund you
I am not a mechanic so could not say - which is why you need an expert.
But I would guess as dangerous

But they must be Court approved.
Or get Halfords to look at it - but they may not produce a report
A Court appointed expert is far beter.
