Hello Clare I have won a court order for access regarded

Customer Question

Hello Clare
I have won a court order for access regarded my 5 years old daughter. I have two questions. Firstly I have a new job, my circumstances has changed and I can not pick up my daughter up once in every fourth week on the Sundays. I have to be on-call as part of my new job. How do I change the order regarded this matter?
Secondly my ex is still being difficult, makes programs on my day, now she told me that I can only take my daughter every other week, she disregards ***** ***** order and not taking it seriously at all. Earlier, in this matter you already advised me and given me a link on how to proceed . The second question is whether I can change the court order and enforce it also at one hearing?

Hi
Thank you for your question and for asking for me?
Remind me what the contact pattern is?
Clare

At the time of the order I studied abroad so the order was: - When I am in the Uk, ( that was about 5-6 months a year) every Sunday, half of the halfterms, and holidays, 2weeks with me during the summer holiday.

Hi
Where are you living now?
Clare
Customer: replied 2 years ago.

In the UK.

Ho
So now you would like three sundays out of four is that correct?
Clare

That is what I am able to do at the moment. Am I braking the law for not being able to pick her up once a month? Zoe's mother however would like me to have her every other Saturdays and Sundays on an alternating bases. I have no problem with that.

Hi
Would that include overnight contact?
Clare
Customer: replied 2 years ago.

Yes, but it is allowed already at half-terms.

Expert:  Clare replied 2 years ago.
Hi
That is fine - so your ex has offered this already?
If so why have you not accepted it?
Clare
Customer: replied 2 years ago.

Because the order is telling us different so I believe it must be changed.

Expert:  Clare replied 2 years ago.
Hi
provided you are both in agreement the Order can be changed without going back to court.
Simply write out the new arrangements and both sign them.
If she breaches the new arrangements then you can go back to court and either ask to enforce and revert back to the old arrangement, or apply for a new Order setting out the new arrangements
However there is no need to delay moving to an order that suits you both
Please ask if you need further details
