I am a director of an event management company that has ceased

Customer Question

I am a director of an event management company that has ceased trading, although is still in existence. The intention is to shut it down, following a divorce. The other director is my ex husband. Can I set up another event company as a director and start trading?

Alex Watts :

Hello my name is ***** ***** I will help you with this.

Alex Watts :

Yes you can.

Alex Watts :

There is nothing stopping you.

Alex Watts :

There may be an issue in you contacting existing customers.

Alex Watts :

But if the old company has ceased trading then I can't see the harm, because you are not in competition with it, but you may want to wait until that old company is dissolved

Alex Watts :

Can I clarify anything for you about this today please?

JACUSTOMER-hquniuo0- :

Thanks Alex. The difficulty I have is that the company probably won't be shut down until the middle/end of next year and I need to earn money in the meantime. So are you saying that as long as I dont contact existing clients my ex husband cannot claim that I am trading in competition with the existing company (even though it is not trading)?

Alex Watts :

Ok - I think you should be ok as long as it is dormant

Alex Watts :

Yes I am saying you can set up a new company without contacting the old customers

Alex Watts :

Does that help?
