I was directed to submit the background evidence I was to rely

Resolved Question:

I was directed to submit the background evidence I was to rely on by a fixed date in a small claims court application. I presume the defence was given the same directions.
The defendant's solicitor has now submitted her evidence, but it was produced and dated the date of the deadline and did not reach me until two days later.
Have I any right to have this evidence excluded from consideration?

Hello,

You may point this out to the court and the court will decide whether or not to exclude this evidence. However, if it was produced and dated by the deadline date, the court is likely to admit it I am afraid.
