Thanks for requesting me.
Do you know what your losses are?
I have made rough calculations...
I need to speak to the team for accurate figures
OK, you will need a Solicitor to represent.
You need to write and set out your losses and request a payment within 14 days or say you will go to Court within 14 days. You should make sure you send this signed delivery and keep a copy.
If they do not refund you pay you can issue proceedings in the County Court. You can either do this online at: www.moneyclaim.gov.uk or by completing form N1 http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n001-eng.pdf and take it to your local County Court.
The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.
If the matter is defended it will be set down for a trial. If the claim is for £10,000 or less it will be a small claim and you will not need representation. As it is over £25,000 it is what called multi track and you need a Solicitor/Barrister to represent as there are many Court rules and procedures to follow
Can I clarify anything for you?
SO, we can just go ahead from this point and claim for losses - based on the unwarranted use "in repudiatory breach of contract"?
Yes, but I would wait until you know for sure what the losses are
Right, ok - I'll get those made accurate.
they have also breached the contract in a number of other ways too. Can I add these to the claim?
Yes, but wait until you know the value of the claim
Can I clarify anything else?
No that's everything thanks.
Great. If I could ask you to rate as always!
