. I am trying to sell my house and on being asked if there

Resolved Question:

Hello. I am trying to sell my house and on being asked if there was any Japanese Knotweed on my property I said there wasn’t but that it was present in my neighbour’s garden. I have since had a buyer fail to get a mortgage due to the Knotweed and so the sale of my house fell through.
I am tempted to start again with a new solicitor and this time not mention my neighbour’s garden but am concerned about the potential ramifications of not passing on this information. Can you tell me if this is a bad idea?

Alex Watts :

Hello my name is ***** ***** I will help you with this.

Alex Watts :

How did the mortgage company find out about the neighbour please?

Customer:

I told my solicitor who told the buyer's solicitor who told the mortgage company

Alex Watts : None of the questions you are asked is if you or your neighbour has this problem?
Alex Watts : I just want to clarify.
Alex Watts : It only asks about you?
Customer:

Yes. It only asked about my property

Alex Watts : Ok. Then you only need to answer what is asked of you.
Alex Watts : If you are not asked about a neighbours property then you don't need to disclose it.
Alex Watts : It is a matter for the other side to make sure they ask the proper questions
Alex Watts : Clealry if you are asked any questions you can't lie.
Alex Watts : but unless you are asked you don't need to volunteer
Alex Watts : Can I clarify anything for you about this today please?
Customer:

Thank you. That is all I wanted to know
