I am a freeholder of a back yard adjacent to a ground floor

Resolved Question:

I am a freeholder of a back yard adjacent to a ground floor flat. The owner of the flat had my yard converted by the housing people to accommodate an invalid access without my permission. The owner of the flat is now dead and his mortgage company is now in situ. Who is liable the housing officer or the Mortgage company as the owners of the flat?

I would suggest that you continue to pursue the mortgage lender. As they have now taken possession this is their responsiblity and any such dispute would be need to declared to any future owner.
