my wife hired a car via her insurance company due to an accident involving her car, the car was delivered when we were home, but no attempt was made to get us to check the vehicle.
The car arrived dirty and according to the sheet (which the driver signed on our behalf) was
checked in the dark.
Due to the positioning of the vehicle, a thorough check was hindered.
we didn't take our first trip in the car until two days later, upon completion of this journey we noticed that the car was scratched.
We are convinced this was not done on our watch and are being told that although my wife signed no paperwork she is responsible for the excess.
What is our position legally on this matter?
