Following on from earlier message re Notice of hearing of Application

Resolved Question:

Following on from earlier message re Notice of hearing of Application for extension of time for filing defence by defendants(I am the Claimant), They have filed a defence after 8weeks.
They would like me to pay their costs!
How do I apply to the court to set aside order re costs are their any specific forms or a letter to the court

but the Defendants had already filed their application before my reply

as they were running late!

The order was made without a hearing right?

no just a notice of hearing of application received yesterday

So the Court has not made an order against you for costs?

and an email from defendants legal rep saying they have filed a defence and cc today

they would agree to hearing being vacated if i pay costs for the hearing

no order re cost

Ok - then no order as to costs seems reasonable.

If you agree to that then the other side can provide a consent order and send it to Court

should this be a letter to the court and state no order as to costs ro is there a specific application form I must send

No need to do that

Just send a letter to the other side.

This is quite normal. They will then do a consent order and send it to the Court
