As a member of a writing group if I distribute a new story to several other members, by email, for assessment and opinion will it affect my intellectual rights?

If as a member of a writing group I email a complete new story to the other members for assessment and opinion how does this affect my intellectual rights
If the literary work in question was your original idea and you were the original creator then you would automatically own the copyright over it. The fact that you had distributed it to others for assessment and opinion would not change that – you would still own the copyright as that is given to you automatically. As long as you do not give the recipients the right to use or distribute that work, you retain the copyright over it. If anyone uses the work without your permission they would be breaching these intellectual property rights. You cannot stop anyone from doing that but if they do then you do have the right to take the matter further and seek either an injunction to stop further use or pursue them for damages incurred as a result of their use. You could remind the recipients when you send them the work that it is protected by copyright and that any unauthorised use or dissemination would be a breach of copyright. It is not necessary to register your copyright ownership anywhere – as mentioned that is given to you automatically if you are the original creator of the work in question.

It would not be a problem as long as you define what that person is allowed or not allowed to do. Say you advise them that they have permission to send it to another person (you can state who if necessary) but that the reason you allow that is only for assessment and opinion and no further distribution is allowed, it would not affect your rights. Also if they give you advise then as long as it is to do with your work and they do not go on to create much original work themselves the original copyright would remain yours - it is only i they start to substantially rewrite your work and actually start creating their own that they could then be creating their own copyrighted material
