Resolved Question:

We are in a multi-track trial with our builder.
We do have a recording I made with my phone when we met him in a public place to discuss the contract. I would like ti use this recording - or the transcript of the conversation - in my witness statement. Is that allowed?

Alex Watts : Hello my name is ***** ***** I will help Uou with this.
Alex Watts : For now please let me know at what stage proceedings are?
Customer:

we are very early stage - even before the formal track starts

Customer:

at last week's application to set aside he produced a forged letter

Customer:

that was allegedly signed by me

Customer:

the recording I have proves it is a forgery

Alex Watts :

Ok. There will be a thing called disclosure and you can list this there.

Alex Watts :

The other side can then ask for a copy.

Alex Watts :

When you give your witness statement you include it in the statement plus a transcript as an exhibit

Alex Watts :

You can then use it

Alex Watts :

Does that clarify?

Customer:

yes - so it is not illegal use use a recording that was made without permission?

Alex Watts :

Yes you can use it, but you may need to seek permission from the Court

Alex Watts :

Does that clarify?
