Contract Law Query. We are a small business (limited company)

Resolved Question:

Contract Law Query.
We are a small business (limited company) that want to stop paying a PR agency as we cannot afford it.
The PR company say we are tied into a contract for the rest of 2015.
They said we can leave the contract but with a 3 month notice period.
This is the basis of the agreement:
They emailed our director the following: The bot***** *****ne is we are happy to change the fee structure to £1,900 per month from January 2015 and to take on this work on the basis that this agreement runs for the whole of 2015 and that there is no fee review based on the above before the end of 2015.
Our director replied: I need to agree to include this for the current rate until the end of the year and for the reduce rate of £1900 from January 2015 inclusive. This will include everything except photography and in your words will include piling on anything I can delegate!
We would like to know where we stand under contract law. We would like to finish with them with immediate effect and not pay a 3 month notice period.
Thanks
Clare

Hello my name is ***** ***** I will help you with this.

Alex Watts :

Is there a termination clause or have they breached the agreement please?

Customer:

There is no formal contract in place, just the email exchange.

Customer:

They have performed their services well, no problem there, we just can't afford it

Alex Watts :

If you can not afford it and there is no contract then you are not bound.

Alex Watts :

Therefore they can not charge you a 3 month notice period.

Alex Watts :

No contract - no notice

Alex Watts :

Can I clarify anything for you about this today please?
