MY MOTHER IN LAW HIRED A BUILDER , HE WAS GIVEN A 70,000 CONTRACT TO RENOVATE HER HOUSE , WITH PAYMENTS BEING MADE IN STAGES TO BUILDERS BANK ACCOUNT, SHE ALSO AGREED TO BUY SOME MATERIALS SUCH AS KITCHEN , FLOOR COVERINGS , AND TILES AND A LOFT HATCH AND LADDER.
THE BUILDER AND HIS EMPLOYEE SUFFERED ARM BRUISES NO BROKEN BONES DURING FITTING THE LOFT LADDER.
HE HAS STOPPED WORK STATING HE NEEDS TO RECOVER .
SHE IS OKAY WITH GIVING HIM TIME . BUT CAN HE SUE HER FOR THE INJURY . SHE DOES NOT LIVE IN THE HOUSE , IT WAS HANDED OVER TO HIM AS A BUILDING SITE .
SHE WAS NOT INVOLVED IN ANY WAY IN THE FITTING PROCESS NOR DOES SHE HAVE ANY KNOWLEDGE OF IT .

Unless she was negligent there is no liability and the builder can't sue. He is self employed and has to do his own health and safety assessment for himself and his employees.

would buying the loft ladder , which she bought in good faith online , be considered negligent ,

she was not there in the house when the accident happened it was unoccupied as given over to the builder as a building site(she has moved in with us while her house is being renovated for the past few months ) , she did not instruct him in any way how to fit it , or what to do or what not to do

she is 70yrs old and has no knowledge of loft ladders.

there is no reason to believe the loft ladder was faulty.

the builder now says the loft ladder was atype he has not worked with before . he is not saying she is at fault and will sue her she is just worried .
