I was claiming housing benefits with my husband back in 2005, But then it got refused and had to pay it back which I was doing, But two years ago I seprated from my husband now i,m on £150.00 a week plus having to pay back £10.00 a week for working family tax credit because he change his job got more money which i rang them and told them about this. which they said its fine as tax credits is wroked out a year behined, Now housing benefits want me to pay them back too, when I told them about all this and aked if they could change it to my husband as he works full time and is on a lot more money then me, plus the benefits was made out in both our names they reply no as I was the lead name. I can't pay this back as i have two children to look after

It was £10,000.00 i got it down to £7800.00

If you have appealed and lost then sadly you have to pay it.

Alex Watts :

You have a decision from an Appeal Tribiunal which is against you.

Alex Watts :

If you refuse to pay then they can take you to Court - if they take you to Court you would lose because you have a valid Tribunal finding against you.

Therefore reluctantly you have to pay it.

The issue is there is a Judgment against you - this means its hard to go behind.

I just want to know if two people are on the benefits why cant they make my ex pay it back as i cant

You are joint and severally liable.

Alex Watts :

This means if you pay it back you can sue him for his share
