Resolved Question:

We have a dispute with our builder. The contract was with a Ltd company of which he is the sole Director. Yet, the payments were made to his personal bank account. We also have him on tape stating that the 'company never got involved'.
Is the above sufficient grounds to name him as a second defendant in the case?

The contract is usually with the person/firm that you pay

Alex Watts :

You paid the builder personally

Alex Watts :

Therefore this is enough to argue the contract is with the builder personally.

Alex Watts :

That being the case you have a claim for adding him as D2

Alex Watts :

Can I clarify anything for you about this today please?
