We live in France Our grandaughter lives with us and her

We live in France Our grandaughter lives with us and her father ,our son. She is 5yrs old. She was born in France.She is with us under a court order as the mother is deemed unfit;The mother is french. Our grandaughter has a British passport and her birth is registered in the UK. She also has a french birth certificate. Does English Law recognise him as the father in the UK, as he is thinking or returning to the UK?

Hello,
Yes. Your son will be recognised as the child's father but as the child is currently in France under French jurisdiction, French law prevails over the issues regarding the child and he should seek the consent of the child's mother or seek a court order in France allowing him to move with the child to the UK, otherwise he could be guilty of child abduction.
He should consult a French lawyer.

Thank you. The Judge here will need an affidavit to confirm Ellie is recognised under Uk law. This will suffice for the judge , he has to adhere to the international law regarding the country of the fathers birth.This will be recognised in a French Court. This you have confirmed.We will be talking to our Barrister here tomorrow, so any action taken by the Mother is annulled as the UK law comes into context regarding the father.
