We hired a man informally as our private driver and he worked with us for just under 10 months. I had to let him go last week after we were dissatisfied with his performance. He caused one accident, 3 parking tickets (although he challenged two), 3 flat tires, several scratches, etc. and simply wasn't up to our expectations. We released him last week and now he wants 3 weeks' untaken holidays, when he was off whenever we were on holidays. He is claiming over £1,000 and says he would take me to the employment tribunal. I have offered £350 as a token gesture. Since we were never in a formal employment agreement and never entered into a contract, I am not sure if he has any point here. Without a formal employment contract, and no formal agreement (we paid him £350 cash weekly), does he have a leg to stand on? I am just too busy to deal with this.
