I am male age 74. I have to work 3 days p/w part time (<£60

Customer Question

I am male age 74. I have to work 3 days p/w part time (<£60 p/d + state pension). All of my funds and past earnings have been invested in our property, jointly owned outright, value +/_ £250,000. I have also paid for extensive renovations and furniture etc as well as bailing my partner out of debt on several occasions.
We have already taken equity release of £32,000 for further property improvements..
My partner, female age 64 works full time and receives a state pension (+/_ £30,000 p/a).
She has invested a much smaller amount in the property and is still persistently in debt.
There are no children.
We agree to separate. I want to remain in the property.
She wants to sell which would mean I would be homeless.
Can she force me to sell?

Hello,

We have lived together since September 2002 and bought this property August 2003. Purchase price £155,000.

I raised a deposit of £73,650 and my partner £24,350. I paid Solicitor's fee £3445 and after a time paid off the mortgage £50,339.

Hi
Did you protect your investment with a Declaration of Trust?
Clare

I have never heard of that so answer must be "No".

We did consider separation in 2006 and an agreement to all preceding facts and figures, together with later developments, was drawn up and signed by both of us.

Hi
My apologies I have been off line
When the agreement was drawn up was any agreement reached about what her share should be?
Will you be able to have her released from the Equity release agreement?
