Resolved Question:

Hi Alex,
Hope you have had a good weekend.
The Just said that the defendants had to serve proper statement in the required format. They have failed to do this.
Can I now object to them giving evidence on their own behalf at the final hearing, since they have not filed the requisite defence.
Thanks

Hello and thanks for asking for me,
Was if recited in the order?
Customer: replied 2 years ago.

Not in the order just that they had to serve it by 4pm on 10th July - the order actually said

"Paragraph 10 (a) of the order of 17th February 2015 is varied to extend the time for service of evidence by either side to 4pm on 10th July 2015."

This was basically with regards ***** ***** serving of statements.

At the hearing the judge did say to them that if the statement were not submitted in the correct format then he would not allow verbal evidence

Expert:  Ash replied 2 years ago.
Then yes. The Court can refuse to hear evidence. You can object to this.
Can I clarify anything for you about this today please?

From what you said yesterday (If I understood it correctly) I can now object to their defence because they have not submitted the statement and request that it is struck out and also request judgement be entered (hopefully that is correct)

Correct.
