Customer Question

We believe an employee is making fraudulent mileage claims. As a small parish council would it be appropriate for a member to follow the employee, take photographic evidence of the journey made by the employee and when the fraudulent mileage claim is submitted to the parish council can we use the members evidence to dismiss the employee under our disciplinary policy for gross misconduct?

We have considered using a private firm for surveillance purposes but they referred to the Regulation of Investigatory powers act 2000 and requested an authorisation under the act.
