1. If a person dies before a testator dies, then they are not entitled to any legacy contained in the testator's will. Accordingly, here the pecuniary legacy of £200 will not go to the person named but will instead fall into the residue in the will. A will only speaks as of the date of death, so if a person is not alive as of the date of death, their legacy is not effective.
