If someone is going to be evicted, for mortgage arrears .
But they die before this is enforced .
Who then owns the property ?

If repossession has not taken place, then the property is still part of the deceased's estate and will be subject to either distribution in accordance with a will or if there is no will, in accordance with intestacy laws.
