Hi, thank you for your question. Please confirm if the cousin has: -a living spouse (husband or wife)-any living children, grandchildren or great-grandchildren-any living parents-any brothers or sisters, or half-brothers or sisters-any living grandparents-any aunts or uncles

Not living think only cousins surviving

Thanks for confirming, if there are definitely none of the above relatives then the cousins can inherit under intestacy rules,You would have only been entitled to inherit under intestacy rules if there are none of the above relatives and all cousins passed away before the deceased. Please provide a positive rating if you found this information helpful. I will not be credited with answering this question without a positive rating. Thank you

Does the inheritance my father would have had pass down to his children as he died before his cousin died ?
Expert:  Harris replied 1 year ago.
If there are other living cousins of the deceased person, then they will inherit the estate and children of the cousins will not. If all cousins had died prior to the deceased and they had surviving children, then those children would inherit. But again, the list of relatives above take precedent in that order.

HiIn fact you will inherit any part of the estate that your father would have inherited whether or not there are other living cousins.I have assumed that your father and the deceased shared a grandfather. Accordingly you need to look at what siblings the deceased's parents had and who many are still alive OR have left living children (or grandchildren)That is the number of parts that the estate will be split intoThe share which your father's parent would have taken will be shared between however many children they had (including your father)Your father's share will then devolve onto you (and any siblings)Clare
