Why didnt you get the summons?
Customer: replied 1 year ago.
i never knew about it until im going through remortgaging recently
Expert:  Jo C. replied 1 year ago.
Yes, but why didn't you get it?Do the DVLA have the right address?
Customer: replied 1 year ago.
it was my car so the summons was in my name ..my ex kept all any letters away from me and let it go to court without my knowledge .i never knew it existed
Expert:  Jo C. replied 1 year ago.
No, but it would have gone to your address and been addressed to you?
Customer: replied 1 year ago.
yes but i never saw any letters . i only found out recently when i was told i had a ccj against me....i didnt even know what a ccj was..as i said she hid any letters she must have received at the house

Who is the creditor?
Customer: replied 1 year ago.
it was a company called parking eye..the court was northampton and ive payed it 165 pounds so its satified but heard it,ll stay on my credit report
Expert:  Jo C. replied 1 year ago.
OK.You can try to get it set aside. It would be a ground to say that you didn't receive the summons. Whether it would be accepted that it was sent to your house but not seen is another matter but it is open to you to try.The defendant might not oppose it as you have now paid.It is generally quite hard to get CCJs set aside though I'm afraid. You can have it marked satisfied though if you have paid. Can I clarify anything for you?Jo

no thats ok. shes already said she.ll deny it so if you say its hard to remove it without her cooperation im proberly wasting my time however unfair it is. i.ll have to ride it out . if it was something like hit and run then would i still be fined for it because it was my car i think not but im being punished for 6 years for something i knew nothing about......thanks for your help anyway

Oh yes, of course she will.I know that one of the ways in which women abuse is to withhold post.
