1. Dear Phil, both the builder and your neighbour have a liability to you for the damage caused. The builder because he cut the branch which fell and the neighbour because it was him who employed the builder to carry out the cutting of the hedge. So, if neither one of them pays up, you can sue them both for the damage caused. However, be aware that in this situation you would normally get compensated by your neighbour or by his policy of household insurance as it was your neighbour who gave instructions for the work to be carried out.
