I have a customer who owes me £37,000. I have advised that I will start a county court action. I know he has no property savings or assets and says he could afford to pay me £50 per month. However, he is 55 in three years time and has a substantial pension fund. He says he will pay me from the tax free cash on that in three years. I'm prepared to accept that. However, that gives me no judgement or binding grip on the situation. I am aware that I cannot get a charge or lien on the pension fund. What do you suggest? I don;t want an "empty judgement" but would that give me more security going forward. I would probably seek an attachment to earnings. But could I enterinto some sort of written contract with him regard what we agree. Would taking as token sum from him each month firm up my position better? Thank you
