Dear Sir/Madam
We have moved to a property on 1 October 2015, from that time I have red itchy eyes and have seen the GP several times. From 27 of November 2015 I started having pains in my lower back or kidney area. On 8 of December 2015 I was on sick leave for a not known cause, while at home under prescribed medication I was still in pain, an ambulance had to be called and I went to the hospital where I stayed several hours. At that time, I still did not know that I had rats in the property.
We have found out about a problem when we found a half eaten potato and rat droppings in the property. The other tenant had suffered scratches on his back in October and I developed yellow dry skin in my fingers. We both had blood tests done for leptospira serology for which we don't have the results, just yet. I work for the NHS in a Hospital as an administrator and the other tenant works for a housing charity.
I and another tenant reported this problem to the agency and had pest control in the property twice to fix structural problems, they have installed a valve in the sewage manhole and sealed holes on the wall. Pest control came back after one month, again to fix other unrepaired external structural problems and repair the valve previously installed, which had been damaged by rats.
From last month, we have paid only half rent because only one room is being occupied. The unoccupied room is carpeted and has a very strong smell, making it unusable. The agency is aware that we are using only one room for the past month because they have visited the property. During the last pest control intervention poison was left underneath the floorboards of the property.
The agency emailed us saying they had written consent of the landlord to end the tenancy agreement.
My questions for you are;
Can we by law, withhold half or all of the rent for all these problems we are going through?
Does the agency have the duty to provide us with alternative accommodation asap?
We want to move before the end of the notice period.
Can we get bad credit or references because we refuse to pay full rent?
Can we get any compensation?
