On the 13 February I bought a second hand car from a dealer
While on the premises they showed me the history book
But when I got home the book was missing
I contacted them the next day they sent me an email saying the book should be in the car
When i confirmed that it wasn’t they sent an email saying will check in the office and get back
Next day they sent an email saying , after speaking with previous owner they never had the book
I believe the book they showed me was a fake ,
At this stage I sent a formal recorded letter on the 22nd of February, rejecting the sale and asking for full refund under the Trading Regulations 2008 for unfair business practices by giving false information and for failing to disclose information when asked if there was anything missing. They replied by claiming that I could not reject the sale as this regulation is only for faulty cars. And the post they placed online did not mention the book
Following my unsuccessful attempt to resolve this issue with the trader, on the 4th of March 2016 I contacted the ombudsman, however as the trader refused to reply to any emails or letters, this too also proved to be of no success.
Do I have a case to take to court?
