Customer Question

Hi, In December 2015 my best friend passed away suddenly. A few months before his death he was in the process of making his draft will. He asked me to come to his home to confirm my details and to explain his death and funeral wishes. I was made co-executor and his other friend was made executor. My friend asked me if I was happy if he gave his house to the other friend to be sold to pay for education for his friends many children as this was his wish, and that I would get money from his private pension fund. I was happy with his wishes and agreed. Yesterday I met with the other friend and asked him for an update. He informed me that he is now keeping the house to rent out and that I cannot receive any monies from the pension as they only pay out to a partner or children. I am now disappointed in the situation as I am sure my deceased friend would be. Also I have not had any communication from my friend’s solicitor. So where do I stand now?

Yes, But only briefly.

Are you named as Executor?
Customer: replied 6 months ago.
No. I was made co-executor.
Expert:  Clare replied 6 months ago.
Sorry - so you are named as one of the two executors of the Will - is that correct?
Customer: replied 6 months ago.
Yes. We were both named beneficiaries, However I was made a co-executor. The other person was made executor.
Expert:  Clare replied 6 months ago.
For clarity - you were only to be an Executor if the other person was not able to do it?
