In respect of adverse possession disputes Practice Note 4

Resolved Question:

In respect of adverse possession disputes Practice Note 4 allows registration to be granted to a person who wrongly but reasonably thought he was owner of the land. The same concession does not seem to appear in Practice Note 5 for unregistered land; does the concession therefore not apply to unregistered land? I refer of course to Land Registry Act 2002

There is no corresponding provision in respect of unregistered land. If you look at practice guide 4, clause 1.1, second para confirms that.
