Hi:
I am a former resident of Beckenham, then I moved to Kent in February this year.
Until then, I rented a small flat in Penge High Street (no. 123a, Flat 1). I lived there from approx. June 2012 to earlier this year, as noted above. My landlord only communicated by email and mobile phone; his name was Michael (Ianonou - or something liked that). His emails always showed a company address.
The Tenancy Agreement gave me an Option, which I took, to pay an extra sum each month (I paid £700 rather than the basic rent of £600) and the landlord - who treated me vilely before I moved out - thereby undertook to pay all rates, water rates, electricity and gas. However by agreement I paid for the telephone, etc. During my time there I did not receive payment requests from any of the above agencies - obviously so, because the landlord was supposedly paying them on my behalf.
All this could also be confirmed by the original letting agents, Leaf Lettings of Brockley. If need be I may be able to find the original agent's calling card with his name - but after four years I do not have that immediately to hand. My bank HSBC would also be able to confirm my payment was the agreed £700 a month.
Now : I have suddenly received a Notice from a debt collectors/bailiffs, Messrs Phoenix of Bolton, Lancs. Their telephone is 0844(###) ###-#### and they have assigned a case/account no.(###) ###-####
Outrageously, Phoenix now demand I pay £2252.52 (plus their generous extras) for Council Tax on that property at 123a High Street, Penge. As noted above, I never heard anything from Bromley Council about paying such Tax while I lived there, because that was clearly not my responsibility.
Quite evidently Bromley's Council silence during all that period indicated their Council Tax was being paid, as was agreed, by my landlord. There were no changes to the Tenancy Agreement while I lived there - the landlord offered, and I accepted, to extend it unchanged, no further specific term agreed, after its initial two years.
I did have just one tentative enquiry from Bromley about Council Tax roughly 18 months ago. So I immediately confirmed by telephone the above Tenancy Agreement. They concluded that it was no more than a computer glitch at their end, told me an Explanatory note as above had been made on the File and I heard nothing more.
I am a pensioner aged 72 and such a sum - which clearly I am not liable for - would be way beyond my means. I should add I do not appreciate receipt of the erroneous, unhelpful and unsympathetic demands for Messrs Phoenix.
