My firm is about to enter into an agreement with a technology provider on a global exclusive basis. However their terms state in case of change of control, our agreement will cease. How can (if at all?!) I guard or protect my firm against this? We don't expect them to sell their firm, but perhaps in a few years they may and what about our exclusive arrangement with is a huge USP for us in our industry?!
