Hello my name is ***** ***** I will help you with this.

Is this commercial or are you private individual?

Customer: replied 10 months ago.
Hi Jamie, commercial. I was sued as a sole trader and the debt was that of a Ltd Company.
Expert:  Jamie-Law replied 10 months ago.

Ok - but the assets belong to a Ltd company?

Customer: replied 10 months ago.
that's right
Expert:  Jamie-Law replied 10 months ago.

OK - then they can NOT make you vacate a hearing. Also they can NOT take anything away that belongs to a Limited company. That is not the person named on the debt.

They can only take assets which belong to the person/company named on the CCJ

Can I clarify anything for you about this today please?

Customer: replied 10 months ago.
The CCJ is in my name and they are wanting to enforce against me hence the set aside hearing in two weeks.Essentially they are saying cancel the hearing or we empty your house and the solicitors are saying the same.
Expert:  Jamie-Law replied 10 months ago.

They cant empty your house. They have no right. They cant break in.

Does that clarify?

Customer: replied 10 months ago.
There is nothing I can do formally to hold them off until the set aside hearing ? They are threatening to take cars.
Expert:  Jamie-Law replied 10 months ago.

They can't - move them away.

You have a set aside application pending

Does that clarify?

Customer: replied 10 months ago.
Should I tell the solicitor who is insisting that the set aside hearing is vacated that he cannot do this ?
Expert:  Jamie-Law replied 10 months ago.

Yes I would. They can't make you vacate the hearing

Does that clarify?
