Not necessarily.

Unless your contract demands action within a particular period of time they will not be in breach of that.

Unless they say they will not act there will be no breach of the substantive contract.

It depends whether you suffer any loss as a result of the delay.

Delays can arise for any reason. It might just be that they are busy or they have lost the report. That wouldn't render them liable per se.

It probably would be worth chasing it up though.

If they won't act upon phone calls then send them a letter through the post recorded delivery.
