Ask a Law Question, Get an Answer ASAP!
Hi, Thank you for your question and welcome. My name is ***** ***** I will assist you. Is this a person or limited company? Is the payment disputed? Kind regards AJ
Hi, Thank you. As he admits the debt you can either:
- Serve him with a statutory demand - this a 21 day demand for payment, if he still does not pay you can then petition for insolvency. This is essentially a warning and will put him under pressure to pay.
- Instruct a lawyer in England and sue him in the county court. This is a more expensive route, and you would not be guaranteed to recover all your costs.
Does he actually have the money to pay? If not then I would just use the stat demand route and force him to commit to a repayment plan - if he does not have the money then going down the county court route could just be good money after bad.
Kind regards AJ
