My company , which runs a childrens day nursery,entered into a rental agreement with a school ten years ago to rent part of the school playing area. The rent was set at £1000 per month . In December 2016 a new ten year agreement was signed by both parties but the monthly rental was left blank . We have continued to pay the old monthly rent until the matter is resolved. We have suggested appointing a surveyor to identify what a reasonable rent would be but the school have insisted that the rent in the old agreement should apply . Indeed they maintain that because we have continued to pay the old rent this constitutes "offer and acceptance" of the old rent .
I believe that a fair rent needs to be identified.
How should I proceed?
