My brother in law has just died,he was left a house and

Resolved Question:

My brother in law has just died,he was left a house and other assets by his sister,to be passed on to him when her husband died.This husband still survives.
Are these assets classed as part of his estate for probate,and are these assets to pass to my sister?
His sister lived in Scotland and will presumably made under Scottish law.
