Boiler stopped working on 4/02/2013. Informed our Housing Group of NO Hot Water or Central Heating. I received a letter stating it would be fixed by the 7/02/2013, Today is the 11/02/2013 & still NOT fixed.
I am a former disabled War Vet with Broken Neck & Back & Numerous internal Health Issues, seriously ill. Since the Boiler Stopped working it has been Below ZERO every single night & NOT much Higher during the DAY ! I reside in the Pennines & receive War Disability Benefit, What is My Legal Position Please I am so weak & Freezing Cold ?

You are protected under the Landlord and & Tenant Act.

What you can do is stay at a B&B until it is fixed and they must pay for it.

You can also get someone out urgent to fix it.

This is because the law means you MUST have hot water and heating.

If you do not you can sue for breach of contract and claim compensation.

As such you should urgently seek Citizens Advice help in terms of emergency shelter and they can arrange an emergency injunction to MAKE the Housing Group fix it.

But by law they must provide you with hot water and heating.

Am I entitled to instruct a solicitor, as I even offered last week to pay for the delivery of the part required to fix the Boiler, but they refused ? Leslie.

THE ATTACHMENT IS TAKEN THIS MORNING OF MY HUSBAND IN BED !

HE IS WEARING A THERMAL LONG SLEEVED VEST, TWO LONG SLEEVED RUGBY JERSEYS & A FLEECE & THERMAL SOCKS, TOGETHER WITH A WARM HAT & SCARF YET STILL HE CANNOT SLEEP DUE TO HIS DIABETES WHICH IS SUPPOSED TO READ " 5 " BUT ACTUALLY READS " 18 !"

HIS DIABETES MEANS HE SUFFERS WITH POOR CIRCULATION, PARTICULARLY IN HIS FEET & THE REST OF HIS BODY " LOCKS UP VIA BODY SPASMS ".

OUR GAS & ELECTRIC BILL IS GOING TO BE ASTRONOMICAL & THAT THOUGHT TOO IS STRESSING ME OUT TERRIBLY & YET STILL WE ARE NO CLOSER TO A ACTUAL DATE TO HAVING OUR BOILER FIXED & THE RETURN OF OUR CENTRAL HEATING & HOT WATER ?

I BED BATH MY DISABLED HUSBAND & SO I MUST CONTINUALLY "BOIL " UP WATER ON THE COOKER USING PANS !

PLEASE, WILL SOMEONE HELP US ? WHY WOULD YOUR HEATING PEOPLE NOT ACCEPT MY HUSBANDS OFFER OF HIM PAYING FOR THE PART TO BE DELIVERED IMMEDIATELY ??

It is Sunday Morning on the 10th February at 03:33a.m. This is Horrific !

We can see our own Breath & my Disabled Husband has not slept all week, our home is Freezing Cold !

Since our Boiler stopped working, every day & every night I have had to put the cooker rings on almost 24/7 & the Oven on with the oven door wide open in the hope that the heat will travel through the house.

My Husband is in excruciating pain with body spasms & I am mentally exhausted with Stress.

Please can anyone help ?

Please forgive me for contacting you once more.

Friday the 8th February 2013 my seriously ill husband received a telephone call from " Steve " from the heating contractors. Whilst Steve was extremely courteous to my husband & understanding, Steve informed my husband that " the Part " required would not be available until sometime next week, but he could not give a day or date.

Out of sheer desperation my husband genuinely offered to " Pay for Express Delivery / Carriage " of the part, unfortunately Steve declined my husbands offer.

My husband was so deeply emotional as it is freezing here & now our young daughter is going to live with her grandfather until this situation is concluded. Yet again it was absolutely freezing as I " cared for my husband " through the night as is always.

The Freezing cold affects his Health Terribly, even with extra Quilt & water bottle - my husband suffers from Horrific Body Spasms which affect his broken back & neck & he just does not get any sleep other than being completely exhausted with his pain & I must administer his Morphine every 4 hours as well as numerous other pain killers.

Why why would they not allow my husband to Pay for the delivery, I do not comprehend any Logic whatsoever by refusing ?
This is about protecting vulnerable People who have extremely serious Health Issues, doing Nothing is not an option, as I have found to my cost with the agony which my husband clearly displays every single day & particularly Night time.
The Temperatures have been & continue to be below Freezing & impossible to handle for my husband.

Please Ms.xxxx, may I ask for your immediate Help with this issue. I myself am suffering terribly too now, I must be of good health to care for my husband, Please.
