Hi,our house was originally a Victorian mansion and was divided

Customer Question

Hi,our house was originally a Victorian mansion and was divided into 2 properties, however one of the neighbours first floor bedrooms overhangs our hallway.we have ownership in our deeds of that room although we can can never use it,technically it is next doors. New neighbours coming in are wanting us to transfer this part over to them as they are struggling to get a mortgage with situation as is. My concern would be if we went ahead and transferred ownership, should we come to sell our property would our prospective buyers have the same problem obtaining a mortgage. Is it better to leave it as it is..for our benefit. ? Please advise

Hello,
I am Law Denning and I am a practising solicitor in a High Street practice. I
have been an expert on this website in UK law since 2008. During that time, as
you appreciate, I have answered thousands of questions from satisfied users on
a variety of subjects. Because we are all in practice with clients and court
and other users, I might not always respond in minutes, particularly evenings
and weekends. Please bear with me in that case

It is my pleasure to try and assist you with this today. Please bear with me
while I gather some further information from you in order for me to be able to
advise you fully.

Do you mean that it should be in their deeds but it is actually still in yrs?

Did you or the neighbours have a problem getting a mortgage before?

New neighbours are struggling to get a mortgage until we amend our title deeds to transfer the overhanging rooms onto their deeds. We had no problems getting the morgage as it is now
